Restore Energy Tax Money to NJ Towns!

For over a decade, state lawmakers have diverted funding intended for local programs, local services and local property tax relief to fund state programs. Senate Bill 330 and Assembly Bill 3804 will return millions of dollars back to municipalities. The Senate bill passed unanimously in March and the Assembly companion is awaiting a hearing. The time to act is now, do not wait!

 

Take Action: Property Tax Relief for Towns

  • Taxes on gas and electric utilities were originally collected by the host municipalities, and when the State made itself the collection agent for these taxes, it promised to return the proceeds to municipalities for property tax relief.

  • Just as municipalities collect property taxes for the benefit of school districts, counties, and other entities, the State is supposed to collect Energy Taxes for the benefit of municipal governments.

  • For years though, State officials have diverted funding from Energy Taxes to plug holes in the State budget and to fund State programs. Instead of being spent on local programs and services or used to offset property taxes, the money has been spent as successive legislatures and administrations have seen fit.

  • The diversion of dedicated energy tax receipts to the State’s General Fund has left many municipalities with serious needs, burdensome property taxes, and further jeopardizes this critical property tax relief funding for future years.

  • Since 2001, municipalities have lost $14 billion in Energy Tax Receipts Funding.

  • Over the years, the State has reduced the Consolidated Municipal Property Tax Relief Aid (CMPTRA), which is also comprised of revenues that should be returned to municipalities, to continue to collect Energy Taxes, while keeping additional revenue that should have been returned to provide property tax relief.

  • Local elected officials are in the best position to decide the best use of these resources, which were always intended to fund local programs and services.

  • S-330 and A-3804 would restore energy tax relief funding over a two-year period, ensuring that each municipality will be restored to the 2007 (SFY 2008) Energy Tax Receipts/CMPTRA level and adjust that amount to account for inflation.

BILL DESCRIPTION

The bill amends the “Energy Tax Receipts Property Tax Relief Aid Act,” P.L.1997, c.167 to require the distribution of additional State aid to municipalities. The bill restores, over a two-year period, approximately $330 million in reductions to Consolidated Municipal Property Tax Relief Aid (CMPTRA) and Energy Tax Receipts Property Tax Relief Aid (ETR Aid) first imposed in FY 2009, FY 2010, and FY 2011 due to State budget constraints.

In FY 2023, municipalities would receive an aid increase equal to 50 percent of the difference between their total payment of CMPTRA and ETR Aid in FY 2008 and FY 2012. The fully restored amount would be distributed beginning in FY 2024 and in each fiscal year thereafter. The bill also extends the existing ETR Aid “poison pill” protection to ensure that each municipality receives an aid amount not less than the combined payment of CMPTRA and ETR Aid to municipalities in FY 2012 and the additional aid distributed under the bill.

The bill also amends current law to require a municipality to subtract any additional amount of ETR Aid it receives pursuant to the bill from its adjusted tax levy when computing that amount for its next fiscal year. By deducting the additional amount of ETR Aid from the previous year’s levy, municipalities would be permitted to raise a lower amount of taxes through the levy for municipal purposes.
